1. Introduction

This Student & Parent Agreement ("Agreement") governs the use of Tutcart's educational services by students and, where applicable, their parents or legal guardians. This Agreement is between ROFL Technologies Private Limited ("Tutcart," "we," "us") and you ("Student," "Parent," "Guardian," "you").

Important Notice

This Agreement supplements our main Terms of Service. By creating an account or using our Services, you agree to both this Agreement and our Terms of Service, Privacy Policy, and Acceptable Use Policy.

2. Eligibility & Age Requirements

Age Categories

  • Adults (18+): May register and use Services independently
  • Minors (13-17): May use Services with verified parental consent
  • Children (Under 13): May only use Services under direct parental supervision with a parent-managed account

⚠️ Age Verification

We may require age verification at any time. Providing false age information is a violation of this Agreement and may result in immediate account termination. Parents are responsible for ensuring their children meet age requirements.

4. Account Registration

Account Types

  • Adult Student Account: Full access, self-managed
  • Teen Account (13-17): Requires linked parent account
  • Child Account (Under 13): Parent-managed, restricted features
  • Parent/Guardian Account: Oversight of linked minor accounts

Account Security

  • Keep login credentials confidential
  • Do not share accounts with others
  • Notify us immediately of unauthorized access
  • Parents should monitor minor accounts regularly

5. Educational Services

What We Provide

  • Access to qualified, verified tutors
  • Online tutoring sessions (video, audio, chat)
  • Educational resources and materials
  • Progress tracking and reporting
  • Secure payment processing

Tutcart does NOT guarantee: specific grades or academic outcomes, admission to any institution, passing any examination, improvement in any specific timeframe. Educational outcomes depend on student effort, tutor quality, and many other factors beyond our control.

6. Student Conduct

Expected Behavior

  • Treat tutors with respect and courtesy
  • Attend scheduled sessions on time
  • Come prepared with necessary materials
  • Communicate professionally
  • Provide honest feedback

Prohibited Conduct

  • Harassment or abusive behavior toward tutors
  • Requesting tutors to complete assignments/exams (academic dishonesty)
  • Sharing tutor contact information or arranging off-platform sessions
  • Recording sessions without consent
  • Sharing account access with others
  • Providing false information

7. Safety Guidelines

🛡️ CHILD SAFETY (POCSO COMPLIANCE)

We comply with the Protection of Children from Sexual Offences (POCSO) Act, 2012:

  • NEVER share personal contact information with tutors
  • NEVER agree to meet tutors in person
  • NEVER share personal photos or videos outside sessions
  • IMMEDIATELY report any inappropriate behavior
  • TELL a parent/guardian if anything makes you uncomfortable

Report any safety concerns immediately to: [email protected] or call Childline: 1098. All reports are taken seriously and investigated promptly.

8. Payments & Refunds

Payment Terms

  • All payments are processed through TutPay
  • Prices are displayed in INR (or local currency for international users)
  • Payment is required before sessions begin
  • Parents are responsible for payments on minor accounts

Refund Policy

Refunds are available as per our Refund Policy. Generally: cancellations 24+ hours before session receive full refund; cancellations within 24 hours may receive partial or no refund; no-shows are non-refundable. See our full Refund Policy for details.

9. Intellectual Property

Content Rights

  • Educational materials provided by tutors are for personal learning only
  • Do not redistribute, sell, or share tutor materials without permission
  • Session recordings (if permitted) are for personal review only
  • Tutcart platform and branding are proprietary

10. Privacy & Data Protection

Data We Collect

We collect: account information, session data, payment information, and usage analytics. For minors, we collect minimal data necessary for service provision, in compliance with DPDP Act 2023.

Parental Access

Parents have the right to: review their child's personal data, request correction or deletion, access session history and progress reports, and manage privacy settings on linked accounts.

11. Disclaimers

TUTCART PROVIDES SERVICES "AS IS" WITHOUT WARRANTIES. WE DO NOT GUARANTEE: academic success, tutor availability, uninterrupted service, or suitability for any particular purpose. Parents acknowledge that online tutoring involves inherent risks and agree to supervise minors appropriately. Tutcart's liability is limited as per our Terms of Service.

12. Termination

Account Termination

You may close your account at any time. Parents may close linked minor accounts. Tutcart may terminate accounts for: policy violations, safety concerns, non-payment, or at our discretion.

Effect of Termination

Upon termination: access is revoked, unused credits may be refunded (minus fees), and data is handled per our Privacy Policy. Certain obligations survive termination.

13. Parent/Guardian Responsibilities

Parents/Guardians of minors agree to:

  • Supervise their child's use of the platform
  • Review tutor profiles before booking sessions
  • Monitor session content and communications
  • Ensure the child follows all platform rules
  • Be responsible for all payments and charges
  • Report any concerns immediately
  • Keep account credentials secure
  • Update contact information promptly
  • Indemnify Tutcart for the minor's actions
