1. Introduction

ROFL Technologies Private Limited ("Tutcart") respects intellectual property rights and expects our users to do the same. This Copyright & DMCA Policy outlines our procedures for handling copyright infringement claims in accordance with the U.S. Digital Millennium Copyright Act (DMCA), Indian Copyright Act, 1957, and Information Technology Act, 2000.

Our Commitment

We respond promptly to notices of alleged copyright infringement and take appropriate action, including removing or disabling access to material claimed to be infringing.

3. DMCA Takedown Notice

If you believe your copyrighted work has been copied and is accessible on Tutcart in a way that constitutes copyright infringement, please provide our Designated Agent with the following information:

Required Information for DMCA Notice

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the material claimed to be infringing, with sufficient detail to locate it (URL)
  4. Your contact information (name, address, telephone, email)
  5. A statement that you have a good faith belief that the use is not authorized
  6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act

6. Counter-Notice Procedure

If you believe your content was wrongly removed due to a copyright claim, you may submit a counter-notice.

Counter-Notice Requirements

  1. Your physical or electronic signature
  2. Identification of the removed material and its former location
  3. A statement under penalty of perjury that you believe the material was removed by mistake
  4. Your name, address, telephone number
  5. Consent to jurisdiction of courts in New Delhi, India
  6. Statement that you will accept service of process from the complainant

After Counter-Notice

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.

7. Repeat Infringers Policy

🚫 ZERO TOLERANCE FOR REPEAT INFRINGERS

Tutcart maintains a strict repeat infringer policy:

  • First Offense: Content removal + warning
  • Second Offense: Content removal + account suspension (7 days)
  • Third Offense: Permanent account termination

We reserve the right to terminate accounts immediately for egregious violations.

8. Safe Harbor Protection

Intermediary Status

Tutcart operates as an intermediary under Section 79 of the IT Act, 2000 and qualifies for safe harbor protection under DMCA Section 512. We do not monitor all user content proactively but respond expeditiously to valid takedown notices. Our safe harbor protection is contingent on following proper notice and takedown procedures.

9. User-Generated Content

Your Representations

By uploading content to Tutcart, you represent and warrant that: you own or have rights to the content, the content does not infringe any third-party rights, and you have obtained all necessary permissions and licenses.

Indemnification

You agree to indemnify Tutcart against any claims arising from your content, including copyright infringement claims, legal fees, and damages.

10. Fair Use / Fair Dealing

Educational Use

Certain uses of copyrighted material may be permitted under fair use (US) or fair dealing (India) provisions, particularly for educational purposes. However, fair use is determined on a case-by-case basis considering:

  • Purpose and character of use (commercial vs. educational)
  • Nature of the copyrighted work
  • Amount and substantiality of the portion used
  • Effect on the market value of the original work

When in doubt, obtain permission from the copyright holder.

11. Trademark Policy

Tutcart Trademarks

Tutcart®, TutPay, TutVerify, and associated logos are registered trademarks of ROFL Technologies Private Limited. Unauthorized use of our trademarks is prohibited and may result in legal action under the Trade Marks Act, 1999.
